Cancellation Policy
ELM Legal Services Ltd (“we”, “us”, “our”) is committed to providing clear and fair information about your cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Cancellation Period
You have the right to cancel your agreement with us within 14 days without giving any reason. The cancellation period begins on the day you sign your Letter of Engagement.
How to Cancel
To cancel your agreement, you must inform us of your decision by making a clear statement. You can:

Immediate Start of Services
If you have specifically requested that we begin work immediately, you acknowledge that:
- You expressly requested services to begin during the 14-day cancellation period.
- You understand this affects your cancellation rights.
- If you cancel after work has commenced, you must pay for services provided up to cancellation.
Refunds After Cancellation
Before Work Begins
If you cancel within 14 days and we have not yet begun work on your instructions, you will receive a full refund within 14 days of your cancellation notice.
After Work Has Commenced
If you cancel after requesting immediate commencement of services, you will be charged proportionately for:
- Work completed up to the date of cancellation.
- Advice provided during consultations.
- Any documents prepared or partially prepared.
What Happens When You Cancel
When you cancel your agreement:
- We will acknowledge your cancellation in writing within 2 business days.
- Work will cease immediately on your instructions.
- Refunds will be processed within 14 days to your original payment method.
- Documents created will not be provided where a refund (full or partial) is due – any draft or completed documents remain the property of ELM Legal Services.
- Original documents provided by you will be returned within 14 days.
Payment Plans and Cancellation
If you have chosen a payment plan:
- Direct debits will be cancelled immediately.
- No further payments will be collected.
- Refunds will be calculated based on work completed versus payments made.
- Outstanding work will cease immediately.
After the 14-Day Period
After the 14-day cancellation period expires, you may still terminate your agreement by giving us 14 days’ written notice. However:
- No automatic right to a refund applies.
- You remain liable for work completed.
- Standard termination provisions in your Letter of Engagement will apply.
Exceptions to Cancellation Rights
Your right to cancel does not apply to:
- Services fully performed before the end of the cancellation period with your prior express consent.
- Emergency services requested outside normal business hours.
- Bespoke services that cannot be returned or reused.
Cancellation Period Disclaimer
We are not responsible or liable for any circumstances that arise during the 14-day cancellation period, which may affect:
- The distribution or administration of your estate.
- Changes in your personal circumstances.
- Changes in legislation that may affect your requirements.
